What Earplugs Were Involved in the Lawsuits?
The earplugs involved in this massive litigation are 3M dual-ended Combat Arms earplugs (CAEv2). These earplugs were sold to the U.S. military under a massive contract with the U.S. Department of Defense. After thousands of the earplugs had been issued to servicemembers, it became known that they were defective. 3M admitted that they knew the earplugs were defective but did nothing to mitigate the risk to active duty soldiers. 3M never recalled the defective earplugs but did stop selling them in 2015.
In July 2019, the United States Department of Justice settled a lawsuit with 3M over allegations that the company defrauded the government. The allegations relate to military-grade earplugs that were sold to the military over a period of years. They are designed for military use with dual ends designed to:
- One side block loud or explosive noises, while allowing the wearer to still hear conversational sounds.
- The other end blocks all noise.
Instead of working as intended, the earplug connection stem was too short, which allowed the earplugs to move around inside the ear unbeknownst to the wearer. The loosened earplugs did not provide adequate protection, which resulted in significant harm.
